A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling allegations, he was detained in federal custody.
